The convicted man, identified as 58 -year -old Fumihiro Otobe Transport businessman, is involved in the violation of Nintendo’s brand rights for Modchips welding to the motherboard converted and online sales for about 195 USD. The revised control panels are reported to have been wrapped with 27 pirated games, but it is not clear how many Otobes are sold before being arrested.
Why OTOBE is accused under the brand law rather than an unfair competition prevention and control law, a law approved in 2019, partly, aimed at the amendment and hack of video game panels, has not been explained. Pokémon Emerald The cartridges because of the potential of the law of competition prevention and control law.
Otobe’s case also brings to Gary Bowser, a 53 -year -old Canadian country, who was arrested in the Dominican Republic in October 2020 for the development and sale of cracking devices for video game devices, most notably Nintendo Switch, as part of the Xecuter copyright infringement group. However, the penalty of Bowser is especially harsh compared to Otobe: He faces three years of imprisonment before being released in 2023 for good behavior and still owes Nintendo millions of dollars, the fine may be decorated from his income for the rest of his life.
Nintendo thanked the US law enforcement agencies for supporting the arrest of Bowser at the time of his conviction in a press release with a steam of a similar victory style that has not been announced to respond to Otobe’s sentence.
